airline will have to pay millions in compensation for delayed flights - Law Report






Airlines could be forced to pay out millions after a judge awarded a husband and wife £680 for a delayed flight.   Last year the European Court of Justice ruled compensation could be awarded if the airline was at fault but the judgement at a court in Staffordshire marks the first time it has been implemented in the UK.

Julian Bray Aviation analyst commented: "Thomas Cook said it had offered Mr Halsall more money than the figure eventually awarded by the court, but as the Court has now ruled on this case, the floodgates could be opened as passengers seek compensation through the Courts  backed by case law."

Airlines will still be able to avoid paying out if they can prove that the delays were outside their control'. The maximum amount that can be awarded to those affected is £480, plus expenses, for hold-ups longer than three hours.

This case relates to Jeff and Joyce Halsall, from Kidsgrove, who took Thomas Cook to court in 2009.

The couple had suffered a 22-hour delay on a flight between Tenerife to the East Midlands because of a technical fault.   A judge initially dismissed the couple’s claims but Mr Halsall decided to appeal after learning of the European ruling. And on Monday the couple were successful.

Raymond Veldkamp, owner of  website Flight Delayed helping travellers fight for compensation, estimates around £73million is owed to travellers across Europe for the past five years.

'FINAL WARNING' ON UNSAFE PILOT FATIGUE REGULATIONS SERVED BY AIRLINE PILOTS




The Prime Minister David Cameron has more than Europe on his mind, as he is amongst 'the decision makers' who have just received a final warning from Britain's airline pilots that the European Union's pilot fatigue plans are unsafe.

Julian Bray Aviation Analyst comments: BALPA contend the proposals from the European Aviation Safety Agency (EASA) will replace the UK's current higher grade domestic regulations.  New standby provisions could see pilots landing after being awake for 22 hours or more, a reduction on the number of pilots required on very long-haul flights, the elimination of the restrictions on the number of early starts pilots can do, which are especially fatiguing, and would allow longer overnight duties than the scientists say is safe.  

Pilots all members of British Airline Pilots' Association (BALPA) delivered a dossier containing scientific reports, correspondence and testimonials to Number 10, the Department for Transport and the Civil Aviation Authority (CAA) who, amongst them, will decide whether to downgrade to Europe's lower safety limits, or to stand up for UK standards.

BALPA has  also released  a video on  < http://www.youtube.com/watch?v=d1cJayMNv9U&feature=youtu.be> showing pilots delivering that dossier in person, highlighting the fact that "Tired Pilots Risk Lives" and demonstrating what could happen if these rules are not significantly changed.

Jim McAuslan, BALPA's General Secretary, said: 'Our message to the decision makers is "You have been warned. We have done everything we can to warn Ministers, politicians, civil servants and EU bureaucrats about why these rules are unsafe and could endanger passengers.  Now, frankly, it's over to them.'

"On behalf of UK cabin crew, Oliver Richardson from Unite the Union said, 'EASA's proposals are hugely worrying for cabin crew and we are working closely with our pilot colleagues to ensure decision makers are aware of our shared concerns.  Alert and well-rested cabin crew are vital to ensuring the safety of passengers on board aircraft, and these proposals will simply make the situation much worse for both cabin and flight crew.

 Pilots and cabin crew from across Europe are also taking part in national coordinated activities and actions to highlight this risk to flight safety.  The European Cockpit Association (ECA) representing pilots and the European Transport Workers Federation (ETF) representing cabin crew are working together on actions including demonstrations in 15 EU member states and a 100,000 signature petition will be handed over in Brussels.

Julian Bray writes: David Cameron delivered his delayed Europe speech this morning, reaction to it has been muted, but the French and Germans are furious, so perhaps it worked. Cameron was clearly nervous and seemed unsure of the content, a bit curates egg, good in parts.  The Prime Minister only opened up during post speech questions, but then was clearly rattled by questions from Nick Robinson BBC, Adam Boulton, SKY and the nice man from ITN. Cameron rapidly closed the session, and almost ran out of the room, still he has to prepare for PMQ's later at 12 Noon...

This morning I want to talk about the future of Europe. But first, let us remember the past.

Seventy years ago, Europe was being torn apart by its second catastrophic conflict in a generation. A war which saw the streets of European cities strewn with rubble. The skies of London lit by flames night after night. And millions dead across the world in the battle for peace and liberty. As we remember their sacrifice, so we should also remember how the shift in Europe from war to sustained peace came about. It did not happen like a change in the weather. It happened because of determined work over generations. A commitment to friendship and a resolve never to re-visit that dark past - a commitment epitomised by the Elysee Treaty signed 50 years ago this week.

After the Berlin Wall came down I visited that city and I will never forget it.

The abandoned checkpoints. The sense of excitement about the future. The knowledge that a great continent was coming together. Healing those wounds of our history is the central story of the European Union.

What Churchill described as the twin marauders of war and tyranny have been almost entirely banished from our continent. Today, hundreds of millions dwell in freedom, from the Baltic to the Adriatic, from the Western Approaches to the Aegean; and while we must never take this for granted, the first purpose of the European Union – to secure peace – has been achieved and we should pay tribute to all those in the EU, alongside NATO, who made that happen.

But today the main, over-riding purpose of the European Union is different: not to win peace, but to secure prosperity. The challenges come not from within this continent but outside it. From the surging economies in the East and South. Of course a growing world economy benefits us all, but we should be in no doubt that a new global race of nations is underway today.

Michael Winner Dies


One of his first films was a travelogue called "This is Belgium." Winner said a few years later because Belgium proved too rainy, it was shot largely in East Grinstead, southern England.

Julian Bray writes: I was sorry to hear of the death of Michael Winner who sadly passed away on Monday age 77. I first met Michael in the early 70's, and in the last few years contributed a few jokes and anecdotes for his Winners Dinners column in the Sunday Times.  Ironically he announced only very recently, he was giving up the column, it was an open secret that the cancer he fought over many years, was finally getting the better of him.  Michael lived a few streets away in Holland Park Kensington, and I in the 70's, lived nearby in Pembroke Place, W8, a little square, behind the Kensington Odeon.

He would drop into the South Kensington Mario and Franco Restaurant Trattoo, from time to time only, to find Spike Milligan unexpectedly playing the piano (something Spike would do to break up the chore of shopping)  surrounded by supermarket carrier bags. Ever affable but not averse to striking terror into the hearts of  restaurateurs if his favourite table was not available or the service,  food, a 'million pound refit' not up to standard. He famously owed a few million to the banks, proving a point for lesser mortals, that if a banker banks with you. rather than you banking with them , the service and respect is decidedly much better.

In 1984, following the murder by shooting of PC Yvonne Fletcher, Michael Winner founded the Police Memorial Trust. Initially the Trust concentrated on erecting smaller monuments at the points where officers had died on duty. From the mid-1990s the Trust also lobbied and raised funds for a single, larger scale memorial to commemorate all police officers who had died in the course of their duties.Winner stated that "Memorials to soldiers, sailors and airmen are commonplace, but the police fight a war with no beginning and no end".

Winner donated £500,000 of his own money to the campaign for a national memorial and the remainder of the total cost of £2.3 million was met by public subscriptiion. After a ten-year campaign, Westminster City Council granted planning permission for it in October 2002.

His wife Geraldine who he first met in the 1950's and finally married him just a few years ago, said he died at his London home after an illness. He had in fact suffered from cancer for a number of years.  No stranger to hospitals or near death experiences, he had to be flown back to Britain from Barbados in Sir Philip Green’s private jet after he suffered a serious bout of food poisoning in 2007. He nearly lost his left leg after being infected by the vibrio vulnificus bacteria from an oyster.

Two years ago Winner, then 75, collapsed with an E.coli infection and was taken to casualty at the Chelsea and Westminster hospital by ambulance.  Doctors spent four days getting the infection under control — with his wife of two months, Geraldine, bringing him specially prepared meals from his favourite local restaurants because he did not dare risk eating hospital food. But there again the e-coli was from an infection caused by Winner eating raw meat AT HOME in the form of steak tartare!

Michael Winner directed over 30 movies included three "Death Wish" films starring the late Charles Bronson. Few if any were acclaimed by the film critics, but the audiences loved them and adverse comment of his films mattered little, he also worked with Hollywood icons including Marlon Brando, Burt Lancaster, Robert Mitchum and Faye Dunaway. Keep many as lifelong friends but as we all do losing a few along the way.

One of his earliest films was for example the 1962 nudist feature "Some Like It Cool"; later, he specialized in thrillers and action movies, including "The Mechanic," "Scorpio" and the violent "Death Wish" series.

Born in London in 1935, Winner was writing a showbiz column for a local newspaper by the time he was 14, and as a student edited the Cambridge University newspaper, Varsity.   After a stint as a film critic, he started his movie-making career on shorts and documentaries.

His 1960s English  films included "West 11," a gritty thriller set in a shabby London neighborhood; "The System," a tale of young men on the prowl in a seaside town; and "I'll Never Forget What's'isname" starring Oliver Reed as a fed-up London adman and Orson Welles as his boss. Truly we will not see the like of Michael Winner again, my thoughts are with his wife Geraldine, I suggested to Michael that on their nuptials he was again punching well above his weight. He agreed.

Stansted Airport to be sold to Manchester Airports Group, will damage HS2 revenue projections




Julian Bray  Aviation Expert comments: "The unexpected enforced sale of Stansted Airport to the Manchester Airport Group is an unforseen major blow to High Speed Rail 2 supporters, as almost immediate predatory air fare and air freight pricing between Manchester and Stansted, will be in place to raise market share, several years before the HS2 railway is completed. MAG will also lobby for a major upgrade of the current Stansted Express rail shuttle into London.  This will certainly seriously damage suggested premium passenger and freight revenues currently being used as justification for the new 'Y; route to Manchester. It will also put another nail in the coffin for any hopes of a Dubai owned Magna Park Road Rail freight interchange terminal at Peterborough, Cambridgeshire as Stansted is already served by rail, and additionally Network Rail recently announced a new link from Peterborough to the west coast rail routes.

 So what is being proposed? Stansted airport, one of the favourite sites to rival  Heathrow as part of an expansion of airport capacity in the southeast of England, is to be sold by HAH formerly known as BAA for around £1.5bn in an enforced disposal ordered by the Competition Commission.

The sale of the UK's third largest airport to Manchester Airports Group (MAG) is expected to be completed by the end of February, the MAG groups' three existing airports and a property business contribute around £3.2bn in revenues to the UK.

The breakup of BAA ordered by the Competition Commission reduces airports operated by the company from seven to four.

The Competition Commission ruled in July 2011,  BAA (renamed  HAH - Heathrow Airport Holdings)  should dispose of Stansted and either Glasgow or Edinburgh (it later sold Edinburgh) airport as part of a breakup which was initially resisted during a succession of legal challenges. This reduces airports operated by HAH from seven to four. Namely Heathrow, Southampton, Aberdeen and Glasgow.

Stansted, located in Essex, is London's third busiest airport, a major hub for budget airlines such as Ryanair, and simgled out by London's mayor, Boris Johnson, as the only viable alternative to proposals to construct a £50bn 'Boris Island' airport in the Thames estuary.  Stansted handles some 17.5 million passengers, and over 131,000 flights a year ; posting pre-tax profits of £86.6m in 2011, and estimated to be £94.2m in 2012.

In addition to operating Manchester, East Midlands and Bournemouth airports, MAG owns a commercial property company, MAG Developments, a £350m portfolio held across the three airports, and is leading the £650m Enterprise Zone development, Manchester Airport City. Suggesting that Stansted will in future substantially expand air cargo hub operations between MAGs' airport portfolio and operate inter group air/road/rail freight transfer, as carried out at by many international airlines at Heathrow. A good example being Alitalia who already truck air cargo transits by road from the UK to its Rome airport hub.
It also runs businesses in car parking, airport security, firefighting, engineering, advertising and motor transport.

MAG had been one of the bidders for Gatwick when BAA put it up for sale while the competition inquiry was going on but it lost out to American private equity group Global Infrastructure Partners which now also runs Edinburgh.

UK QE2 BID FAILS AS SHIP DESTINED TO BE LUXURY DOCKED HOTEL IN FAR EAST ownership to remain with Dubai




The QE2 is finally set to be renovated into a luxury floating hotel complete with three Michelin-starred restaurants, claim the owners of the ship, United Arab Emirates real estate developer Nakheel;  
they reported the ship would be moved to a dry dock in Dubai to be converted into a five-star, 500-room hotel.    Nakheel bought it for £50m, and the liner left Southampton for the last time on 11 November 2008; it is now being kept in the inner harbour in Port Rashid.

Daniel Chui, of Oceanic Group, which is advising the consortium, told the BBC: "We are going to lavish many millions of dollars on this magnificent ship to restore her to the splendour of her glory days as an icon of the very best the world has to offer."   He added that "an international tourist city in the Far East" had been "firmed up" as its destination. This confirms reports that Chinese crew were seen boarding the ship three weeks ago, replacing the existing crew. The fears were that the iconic cuise liner would be sold to China for its scrap value...

As well as three top-notch restaurants, the refurbishment will include a shopping centre and a maritime museum.   However according to several sources, there is no firm timetable for the QE2's upmarket renovation and journey east.

Khamis Juma Buamin, chairman of shipyard operator Drydocks World, said it will first undergo full checks for seaworthiness in Dubai that could take up to three months.  The interior of the ship has been well maintained since its last voyage in 2008, and Dubai will retain ownership of the vessel after its conversion to a hotel.

Buamin said technicians will now do all the necessary upgrades to the hull, engine and other systems, but gave no cost estimate, noting it will be "a lot" to get the over-45-year-old ship ready for the seas.

The 963ft-long was once the Cunard flagship carrier, and carried almost 2.5 million passengers in more than 800 Atlantic crossings and cruises following its launch by HM Queen Elizabeth II from the John Brown Shipyard in Clydebank, Scotland  in 1967.

Why did Julian Bray call the Dreamliner Boeing Light?

Julian Bray Aviation expert writes: It is depressing news. as I seem to recall during the flashy launch of the Boeing Dreamliner 787 way back in October 2011,  I commented, the new aircraft was "almost a make or break diversion for Boeing as Airbus continues to encroach on all the American Boeing markets and is now taking parts of the US domestic market."   

The 787 however delivers a 20 percent improvement in fuel efficiency. Most of the 787 is covered in carbon fibre, a high-tech thin plastic that is very strong but still lightweight. Military planes have used the material for years, but this is the first time so much has been used on an airliner in commercial service.

 The Dreamliner features the largest entryways, overhead bins and windows of any airplane flying. Blake Emery, Boeing’s Director of Differentiation Strategy, said at the time these upgrades “improve harmony inside the cabin. The design puts equal emphasis on form and function."  The marketing men concentrated on the in flight experience, and by all accounts this aircraft uses more electricity than in any other any aircraft types being offered on the international stage.

Also at the time of launch, it was given special fast track regulatory clearance for its multiplicity of  innovative features and the superlight carbon fibre hull sections. This raised many an eyebrow at the time and angered competitors as they saw the situation as special pleading by Boeing.  Sadly the 787s  wings and the troublesome Lithium battery arrays are both made in Japan, and that is where the majority of the aircraft were initially operating, but now parked up.

The decision by the FAA to ground the whole aircraft type, could not have come at a worse time, many airlines are financially just holding on. Some 30 are expected to go in to administration this year, and the financial firms they lease the aircraft from, are also taking a very hard nosed line on future air leases and aircraft type approval.

As a former president of Italian airline Alitala,  Umberto Nordio once explained to me: "You have to realise these are very valuable assets, we move on an hourly basis,  all around the world." Clearly any adverse public relations or the slightest dip in passenger confidence will leave a lasting mark not only on the airlines concerned, but also on the financial institutions who actually own them, and air lease them out to the airlines to operate. The downside is that the airlease company, could well be left with dozens of Dreamliners, all neatly parked up and mothballed in Death Valley.    

But as the marketing people enthused at the launch "The plane has a carbon fibre design making it more fuel efficient than traditional heavier planes. For the passengers, using the plane in-flight will be a much more intuitive experience, from storage-bin latches to the control of how much light seeps through the expanded windows. Other improvements include more pressurized cabin air, larger windows that can be electronically dimmed and hands-free toilets.

The wings on the 787 were made in Japan by Mitsubishi Heavy, the first time that a foreign contractor has built the most complex component of an aircraft for Boeing.They don't say who made the passenger emergency slides, these double as floating life rafts, but the world has seen their innovative design complete with location warning lights, plus hundreds of  practical demonstrations as passengers have uploaded their personal rapid exit experience on YouTube for all to see - possibly for generations to come.

It cannot be too long before the Dreamliner is dubbed Nightmareliner 888, or when a brand becomes toxic,  the name gets changed or vapourised ,MacDonald Douglas became MD almost overnight, after a series of tragic incidents.

LONDON HELICOPTER CRASH 2 FATALITIES: Vauxhall Crane had night only warning lights


An Augusta 109 helicopter crashed into a high rise jib crane in central London (Vauxhall) at around 8am this morning (Wednesday January 16th), The cloud mist base was low, with poor visibility.

+++ Breaking 11:30am  Police confirmed the helicopter was on  scheduled commercial helicopter route from Redhill in Surrey to Elstree but  landing denied due fog diverted due to weather conditions possibly retuning to Redhill. 

+++ 2 fatalities (One helicopter pilot - no passengers) and one in close proximity to helicopter) 9 wounded, 5 minor and further 4 released after treatment.  

+++ Road closures in area,  Tube closed and some main line rail services cancelled.

Julian Bray writes: A warning notice NOTAM (copy below) was issued to flyers about the Vauxhall high rise jib crane on January 7th, it gives the height of the structure as 770 ft. 

Although the crane is said to have been lit at night, the incident happened at around 8am, so the night time warning lights might have been automatically switched off . 

These crane jib beacons are not designed as daylight fog lights, and even if lit during the day would not have been seen by the pilot until it was too late.

Heathrow pre-empts and cancels flights IN CASE of wrong type of snow?!

Snow cleared on the ground, but ice on the wings...


As the UK's army of gritter trucks swings into action.  Heathrow, the London airport, said it was preparing to cancel flights in advance of any snowfall, and that the decision would be made later on Sunday January 13th. Politicians have been jumping up and down, at the decision, but if they thought the process through, the operational rationale, is in fact sound, writes travel expert Julian Bray 



Signposting flight cancellations before a regional and runway snow dump, gives a clear advance warning before passengers start travel to the airport, reduces bunching of passengers with no flights in prospect and airlines more time to rebook their clients onto other flights. It also reduces the amount of aircraft repositioning which any prolonged snow episode will cause; needlessly burning millions of litres of aviation fuel with no fare passengers on board or cargo in the hold... It will also have a knock on effect for supermarket air freight - retail food prices suddenly upwards. The shopping public have been duly warned.

Some 5 inches of snow, in parts of Britain will fall on Monday, commuters already warned to expect rush hour and return travel disruption right from the start of the week.  Heathrow temperatures will drop to below freezing on Monday, but in rural areas a few degrees colder  A heavier dump between 2-5 inches is expected over central England and eastern England on Monday.
