TUNISIA BEACH KILLING OF 30 BRITISH TOURISTS - CORONER REJECTS NEGLECT CALL.





All 30 British victims of the 2015 Tunisia terror attacker were "unlawfully killed", the coroner has said.

Coroner Nicholas Loraine-Smith rejected calls from lawyers representing some of the dead people's relatives to rule "neglect" by travel firm TUI or the hotel owners, played a role in their killing.


The Coroner said the law on neglect did not, in his view, apply to tourists who voluntarily went abroad, and that better planning and actions by hotel staff may not have prevented the atrocity in which thirty-eight people were killed by radicalised Islamic extremist Seifeddine Rezgui.


The judge said he would rule on each British victim individually, adding: "My conclusion is that all thirty were unlawfully killed."


The judge said although in general the response of the hotel staff was "disorganised and chaotic" some of them displayed "conspicuous personal courage" in their efforts to protect the guests.



He said this courage was also shown by guests at the hotel too.


Summing up the evidence heard during the inquest, Judge Loraine-Smith referred to the response of police and military, including the officer who "fainted through terror and panic", and the guard who took off his shirt to hide the fact he was an officer.


He said with the exception of two marine guards, no police entered the hotel grounds until the gunman had killed all thirty-eight tourists.


The judge also referred to a police unit that stopped off to first pick up more weapons instead of going straight to the scene.


"They had everything they required to confront the gunman and could have been at the scene within minutes," he said, adding: "The delay was deliberate and unjustifiable."




The travel agents association ABTA has also issued a statement which in the circumstances is somewhat light on detail on their role at the time:


“The Sousse terrorist attack was an appalling attack on innocent holidaymakers involving a terrible loss of life. It is entirely appropriate that there has been a thorough investigation into what happened on the day and in the run up to the incident. The coroner has concluded that all victims were unlawfully killed by the actions of a lone gunman.


“The safety and security of holidaymakers is of critical importance to the travel industry and we will carefully review the Coroner’s report when it is published at the end of March to see if there are any learnings for the industry.”

Aviation seen as 'collateral damage' as 'crazy' and 'reckless' personal injury payouts are to rise sharply under changes to the formula used to calculate compensation sums.




Julian Bray Aviation security analyst and broadcaster, suggests the aviation sector will soon be "unwitting collateral damage victims" as Personal injury payouts are expected to soar under changes branded by insurance industry leaders as 'crazy' and 'reckless in the extreme' just announced by Lord Chancellor Liz Truss, to the accepted insurance industry formula traditionally used to calculate compensation sums for life-changing injuries.

The move will affect financial awards given to victims of medical negligence, road traffic collisions, air accidents, railway casualties and other incidents where compensation is involved.

The changes announced by Lord Chancellor Liz Truss will in particular have an acute impact on major public bodies with large compensation bills such as the NHS, and millions of drivers and travellers could also see motoring and travel insurance costs rise. 

Private firms, large and small together with PLC's  will also be affected as the Corporate Manslaughter Act is already law, and evidence 'legal bundles' collected under that Act could equally be applied to compensatory pay outs. 

The measures, delivered on Monday to the London Stock Exchange, relates to a calculation called the Discount Rate, which has been unchanged since 2001.

When victims of life-changing injuries accept lump sum compensation payments, the actual amount they receive is adjusted according to the interest they can expect to earn by investing it.

In finalising the compensation amount, courts routinely apply the Discount Rate, with the percentage linked in law to returns on the lowest risk investments, typically Index Linked Gilts.

Claimants are always treated as risk-averse investors, financially dependent on the lump sum, often for long periods or the duration of their life.

Awards using the rate should put them in the same financial position had they not been injured, taking into account loss of future earnings and care costs.

From March 20th 2017, the Discount Rate will fall from 2.5% to minus 0.75%.


As well as seeing compensation payments rise, the decision will have a possibly not foreseen  knock-on effect on public services with large personal injury liabilities such as the NHS, which saw clinical negligence costs in England rise from £1.2 billion in 2014/15 to £1.5 billion the following year.

The move is also likely to have a significant impact on the insurance industry.

Huw Evans, director general of the Association of British Insurers, called the decision "crazy" and "reckless in the extreme".

He added: "Cutting the discount rate to minus 0.75% from 2.5% is a crazy decision by Liz Truss.

"Claims costs will soar, making it inevitable that there will be an increase in motor and liability premiums for millions of drivers and businesses across the UK.

"We estimate that up to 36 million individual and business motor insurance policies could be affected in order to over-compensate a few thousand claimants a year."

Ms Truss is also Justice Secretary, but made the decision in her capacity as independent Lord Chancellor.

She said: "The law is absolutely clear, as Lord Chancellor, I must make sure the right rate is set to compensate claimants. I am clear that this is the only legally acceptable rate I can set."

The Government meanwhile says it will ensure the NHS Litigation Authority has additional appropriate funding to cover changes to hospitals' clinical negligence costs, while the Department of Health will work closely with GPs.

Ministers will also launch a consultation to consider whether there is a better or fairer framework for claimants and defenders, and Chancellor Philip Hammond will meet representatives of the insurance industry to assess the impact of the rate adjustment.

Whatever happens, it marks an upcoming bonanza for ambulance chasers, 'no win, no fee' (contingency)  class action lawyers, and insurance brokers...

WILLIE WALSH (IAG) SMILES AGAIN WITH A LITTLE HELP FROM CHEAPER FUEL & PRUDENT HOUSEKEEPING BUT 'MIXED FLEET' CABIN CREW STRIKES CONTINUING...





The owner of the British Airways  (BA)brand International Airlines Group (IAG) said it is to return 500 million euros ($529 million) to investors after reporting higher annual profits on Friday, helped by lower fuel costs and internal cost-cutting. The currency slump - devaluation of the £sterling, clearly not helping matters. BA in the UK is currently facing  waves of cabin staff strikes and industrial action from its 'mixed fleet' [allegedly] lower paid recenrtly recruited employees.

Europe's largest airline groups Willie Walsh hoping for continuing open skies agreement post Brexit.  IAG annual operating profit rose 8.6 percent to 2.5 billion euros, in line with expectations, sending shares up 2 percent. IAG expected higher profits this year.

IAG's British Airways transatlantic business, currently based at London's Heathrow, held up well compared to Europe's highly competitive budget market. London Heathrow has last Friday reported record passenger throughput during 2016.


Walsh said that across IAG he expected 2.5 percent capacity growth in 2017, with Irish airline Aer Lingus expected to grow  at a faster rate than British Airways. For 2016, operating profit before exceptional items rose despite revenue slipping by 1.3 percent to 22.57 billion. Benefitting from a lower fuel prices and deep cut cost savings, all contributing.

IAG suffered from adverse currency rates to the tune of 460 million euros triggered by a slump in the British pound sterling following Britain's June 23 vote to leave the European Union. Fund managers now going long on the dollar, although one bank Nomura says this position might well be reversed by the year end in December.

"IAG has reported solid and in-line Q4 and (2016) earnings despite a tough yield environment and currency headwinds," claimed analysts at Cantor Fitzgerald.

Analysts equqqlly expect IAG, which also owns Spain's Iberia, to achieve a 2017 profit of 2.5 billion euros, in line with this year.

IAG said it planned to carry out a share buyback of 500 million euros this year, and announced a final dividend of 12.5 euro cents per share. ($1 = 0.9459 euros)

£69 UK flights to New York from June 15th - and 10 new routes





Low-cost airline Norwegian is introducing (for a limited period) a series of new £69 (!) transatlantic flights from five cities in the UK and Ireland to the US, we repeat, offering tickets from £69.


Norwegian will launch ten new routes with 38 new transatlantic flights this summer from Edinburgh, Belfast, Cork, Shannon and Dublin.


The flights will start on 15 June from Edinburgh, with the others following on 1 July.


The flights will serve three destinations on the US east coast, with a focus on smaller US airports.

Geneva - The International Air Transport Association (IATA) welcomed the 'entry into force ' of the Trade Facilitation Agreement (TFA) today. This follows the ratification of the treaty by two-thirds of the members of the World Trade Organization (WTO).
 
"The Trade Facilitation Agreement will cut red tape at the border for faster, cheaper and easier trade. That’s great news for airlines, which deliver about a third of the goods traded across borders by value.


And it’s a particularly timely reminder of the dangers of the current protectionist rhetoric that we are seeing in various parts of the world. Trade leads to growth; and growth results in prosperity.


With the treaty now in force, we urge governments to move forward with early implementation so that the TFA’s substantial benefits can be realized," said Alexandre de Juniac, IATA’s Director General and CEO.
 
The TFA was concluded at the Bali Ministerial Conference in December 2013. The agreement promotes trade by establishing harmonized rules for further expediting the movement, release and clearance of goods crossing borders, including goods in transit.


Particularly important for the air transport industry is the commitment to accepting e-payments and electronic documentation. This aligns with the industry’s goal to modernize air cargo with its e-freight program.
 
"Aviation is the business of freedom. Air cargo is a vital link in the manufacturing supply chain and between producers and consumers.


We look forward to working with governments and airlines to maximize the benefits of the TFA and make air cargo an even more potent catalyst for jobs, growth, and prosperity," said de Juniac.

'Newish' wide-bodied aircraft head for storage, and create a headache for aircraft leasing companies- and then there is 'BREXIT'



Could London Heathrow Runway expansion become the latest Brexit casualty?

Julian Bray writes: On a day when scientists are now saying we should eat ten not five pieces a fruit a day. Just who can you believe?  We are now nearly three months into 2017 and  finds manufacturers producing wide-body aircraft at historically high production rates.

This follows earlier periods of productive famine and other fiscal constraints fanned by poor economic conditions and corresponding delays in new-technology replacement programs. 

But consider the likes of Boeing and Airbus are now seeing reduced orders in a softening primary and weak secondary marketplaces. They are unable to fill production slots currently available before the production and rollout of next generation Airbus A350 and Boeing 777 aircraft.



To add to the complications, the quantity of wide-body aircraft in storage remains impossibly high, and the majority are younger ex-lease aircraft well below 20 years of age.

Also consider the growing numbers of current generation Airbus A330 and Boeing 777 aircraft being returned off lease in the next few years, some being returned early or swapped over for narrow body single aisle aircraft. A wide-body aircraft after or secondary market, which is now dominated by lessors, increasing unable to sell on or secondary lease their property.

The current twin-aisle wide-body market is also affected negatively by the increasing range and capacity of larger narrow-body aircraft such as the Airbus A321LR and soon by Boeing’s new 737 MAX family of aircraft which can easily operate point-to-point more than half of present wide-body routes

As a result airlines are increasingly hesitant to acquire larger wide-body aircraft as they can only be filled on densely travelled routes. It is also ironic that premium fares are still financially supporting economy price points.

The switch coincides with the general trend towards 'point to point operations' rather than hub connectivity. This trend does help our smaller regional airports, such as Stansted with operators such as Ryanair demanding a less than 25 minute turnaround for their aircraft and competitive landing and handling charges.  

But despite assurances from local airline management, all is not settled. Brexit is looming...  

With the outcome of Brexit negotiations still very uncertain and the UK Government, seemingly with very few seasoned negotiators facing highly experienced EU counterparts, the UK having over the last few years under the Cameron Government reduced the number of experienced civil servants - Post Brexit and still uncertain in terms of post EU access and negotiated agreements.

UK Airport managements should not be surprised if long standing established airport contracts with airlines are also rapidly renegotiated, as the new world order presents itself.  Moving house for any airline is so easy, you just immediately reroute your aircraft. 

Third-party operated ground handling resources are usually hired in, so no problem there either.  Both EasyJet and Ryanair have operating companies set up within Europe...

Financially Sterling has taken a hammering as brokers scrabble to go long on dollars (ie dump Sterling) its called the FOMO effect (FOMO - Fear Of Missing Out!)

Curiously Nomura bank (alone) is suggesting the Pound may nervously recover by the end of 2017.  


The first Airbus A380 end of lease returns will start during 2017. There has been very limited secondary market for the A380.

Given the aircraft’s no longer fashionable size, there are very few operators in current market conditions willing to risk using them. 

Reconfiguration costs are likely to be substantial for a traditional 3-class layout. Further damaging the secondary or after market, operators are now very thin on the ground and dominated by Emirates which accounts for nearly half of the aircraft in-service and on firm order backlog.

Observers suggest that such operator concentration is detrimental to asset liquidity and opportunities to place used aircraft.

Present first-tier operators have configured the aircraft with now outdated premium seating layouts effectively well below 500 seats. Airbus and lease company Amedeo, are hopeful that the A380 will enter service with low cost and charter carriers in configurations approaching 700 seats for long haul leisure markets, thus maximising the revenue potential of the aircraft.

Market participants are also optimistic that growing hub congestion (and the rush to point-to-point in some regions) will eventually influence operators to order or lease VLA aircraft such as the A380 and 747-8i.

Potential opportunities may also lie with operators such as International Airlines Group (IAG) - owners of the British Airways brand-  which sees second-hand A380s as an attractive proposition. 

Further complicating the outlook for a secondary market for the A380s is the lack of a freighter conversion program as well as possible derivative developments – fuselage stretch (-900), re-engined (A380neo) - being explored by the OEM.

Most affected in terms of value diminution are low gross weight early-build examples, which encountered wing component cracking issues requiring extensive repair work.

Fasten seat belts, the ride will be bumpy, for all of us...

Latest Trump release and Air France has recently changed its remaining orders for two new Airbus A380 superjumbos to the three of the lighter twinjet A350s, according to Reuters.

You may not recognise this, after the events of the last week but this is the latest media release from Trump Towers aka The White House. No wonder Air France is changing its remaining orders for two new Airbus A380 superjumbos to the three of the lighter twinjet A350s!  Expect others to follow, once the implications of the Trump executive orders and portfolio appointments impact on the aviation industry. We might not even need the additional runway at London Heathrow!

Air France has recently changed its remaining orders for two new Airbus A380 superjumbos to the three of the lighter twinjet A350s, according to Reuters.

Air France originally ordered twelve A380 aircraft and the cancellation had been expected after the change was flagged in March 2016. The remaining ten aircraft are already in operation.

Lately, airlines tend to replace large four-engine aircraft like the A380 to smaller and newer jets like the A350 and Boeing 787, making the former aircraft‘s demand wane. The demand for the main competitor in the segment - Boeing‘s 747. The model saw two its cancellations in January 2017.





In January, Airbus registered four new orders overall, or two, after the A380 cancellations. So far the industry projects a slower year, as the airlines continue to take stock after a longer than expected order cycle.

It delivered 25 aircraft in January 2017.
In 2016, Airbus net orders fell by 32%, concluding to 731 jets. Due to slower demand for aircraft, especially for bigger jets, the company is predicted to target something closer to 600 jets in 2017.

Russia demands extra security at Egyptian airports before considering resumption of flights





"The work on this project is almost finished, most items on the agenda for the improvement of the security on flights from Egypt have been carried out. However, there is a number of details that we are not satisfied with," Matvienko said.

Speaking to Sputnik News Agency, Matvienko stressed that Russian stance on the matter had not changed and the security of its citizens remains a priority.

The upper house speaker confirmed that she would go to Egypt at the beginning of March on a planned official visit, unrelated to the flight security issues.


Russia has carried out a series of security checks at Egyptian airports after a crash of a Russian passenger plane that exploded soon after it took off at the Sharm El-Sheikh airport in October 2015.

The Airbus A321 crash over the Sinai desert killed 224 people aboard. The Russian Federal Security Service (FSB) classified the air disaster, the deadliest in Russian and Soviet history, as a terrorist attack.

Russia grounded flights to and from Egypt in November 2015. Transport Minister Maxim Sokolov said in January that the February inspection would likely be the last and suggested restrictions could be lifted in the near future, but the latest inspection showed that some details still had to be improved.

FRESH WAVE OF BRITISH AIRWAYS STRIKES BY 'MIXED FLEET' LOWER PAID CABIN CREW FROM FRIDAY




IAGs' British Airways 'mixed fleet' category  cabin crew strikes from Friday
British Airways (a brand within the International Airlines Group -IAG) cabin crew are staging a another series of four strikes in their long-running dispute over pay. 

The Unite union claims its members at the airline were 'piling on the pressure' by walking out from February 22, on top of a four-day stoppage from the end of this week.

Members of the so-called 'mixed fleet', essentially newer employees,  claiming 'poverty' pay levels, have taken 11 days of industrial action so far this year in protest.

Making the point that strike action is expensive both for employees and the employer, Unite regional officer Matt Smith said: 'Every hour British Airways "wet leases" an aircraft from another airline to cover striking cabin crew it pays out £2,000 to £3,000 to that airline.

'Our estimates put the amount of money British Airways has spent on defending the dispute and poverty pay at £1million.
'This is money which the airline has taken a conscious decision to give to other airlines rather than addressing pay levels which are forcing hard-working mixed fleet cabin crew into financial hardship.

'We urge British Airways to reconsider its costly intransigence and enter talks at ACAS to reach an agreement.'


The two sides have clashed over pay rates, with Unite union pointing out that 'mixed fleet' cabin crew earned an average of £16,000 a year, including allowances, however BA insist  no one was paid below £21,000.

British Airways said all of its customers will fly to their destinations during the strikes from Friday.
All flights to and from London Gatwick and London City will operate as normal, as will the 'vast majority' of flights to and from London Heathrow.

The airline said in a statement: 'To enable all customers to travel we will be merging a very small number of flights at Heathrow - about 1% of total flights planned. We are contacting customers on those flights with the options available to them.
